Tipped Employee Overtime Formula

Overtime for tipped workers is figured on the full minimum wage, not the lower cash wage. The overtime cash rate your employer must pay is:

OTcash = (MW * 1.5) - TC

Where the tip credit is the gap between the minimum wage and your direct cash wage:

TC = MW - CW

Variables:

  • OTcash is the direct cash rate owed for each overtime hour (tips are on top of this)
  • MW is the applicable minimum wage — the federal $7.25 or your higher state/local minimum
  • CW is the cash wage your employer pays per hour (federal floor is $2.13 for tipped work)
  • TC is the tip credit, which stays the same during overtime — it is never multiplied by 1.5

Example Problems

Example 1: A server paid the federal $2.13 cash wage works 46 hours in a week.

TC = 7.25 – 2.13 = $5.12. The full overtime rate is 7.25 * 1.5 = $10.875, so OTcash = 10.875 – 5.12 = $5.755 per hour.

For 6 overtime hours the employer owes 5.755 * 6 = $34.53 in overtime cash wages, plus 40 * 2.13 = $85.20 of regular cash wages, with tips on top.

Example 2: A bartender in a $12.00 minimum wage state is paid a $5.00 cash wage and works 5 overtime hours.

TC = 12.00 – 5.00 = $7.00 and OTcash = (12.00 * 1.5) – 7.00 = $11.00 per hour, so overtime cash pay is 11.00 * 5 = $55.00.

Frequently Asked Questions

Why isn’t tipped overtime just 1.5 times my cash wage?

Because the FLSA requires overtime to be calculated on your regular rate, which for tipped workers is at least the full minimum wage. The employer may still take the same tip credit during overtime hours, but the credit itself never gets multiplied. Paying 1.5 times $2.13 is one of the most common wage violations in restaurants.

Do my tips count toward overtime pay?

No. Tips belong to you on top of the cash wages in this calculation. The only role tips play is allowing the employer to claim the tip credit at all — you must actually receive enough tips to bring your total hourly earnings to at least the minimum wage in every workweek, including overtime weeks.

What if my state does not allow a tip credit?

In states like California, Washington, Oregon, Minnesota, Montana, Alaska, and Nevada, employers must pay the full state minimum wage in cash before tips. There, overtime is simply 1.5 times the full minimum wage (or more), with no credit subtracted — enter a cash wage equal to the minimum wage and the calculator reflects that.
